Sanjay Kumar and Others Vs State of Haryana and Others

Seeking directions to the respondents to pay leave travel concession (LTC) for the block year 2020-2023, Dress Allowance, Dearness Allowance as well as 5% annual increase in the salary to the petitioners along with the arrears, the present writ petition has been filed.

2 It has been averred in the writ petition that the petitioners are working against various technical posts including Helper Welder, Helper Mechanic, Helper Carpenter, Helper Electrician and Helper Tyreman (all technical posts) on contract basis in Outsourcing Policy Part-II. Their services were terminated after about one year in 2017. It is averred that the initial appointment of the petitioners was for a period of six months and was extended twice taking into consideration the workload. Petitioners were

thereafter reengaged in outsourcing one policy in May 2018 and have been continuously discharging their duties regularly and are being granted extensions from time to time. It is averred that since 01.08.2019, the monthly salary of the petitioners was increased to Rs.16,900/- from Rs.13,500/keeping in view the instructions and the judgment of the Hon’ble Apex Court directing grant of minimum pay scale as well as in view of the principle of equal pay for equal work. The said increase has been implemented w.e.f. August 2019.

3 It is further averred that the petitioners have submitted a representation for being granted the technical pay scale i.e. Rs.25,500/-, however, the same was rejected vide letter dated 16.06.2021 by referring to the Ordinance dated 10.12.2013. It is also averred that the petitioners made requests to the respondents to grant them the benefit of LTC, Dearness Allowance, Dress Allowance as well as 5% annual increase in their salary like other departments, however, no decision was taken by the respondents thereupon as a result whereof, a legal notice dated 02.02.2025 (Annexure P- 1) was served upon the respondents. It is averred that the petitioners pray for issuance of a direction to the concerned respondents to take a decision on the legal notice dated 02.02.2025 (Annexure P-1) and to pass a speaking and reasoned order in accordance with law and in a time bound manner.

4 Taking into consideration the prayer made in the present writ petition as also the facts noticed, I am of the opinion that issuance of a formal notice may not be necessary in the present case in view of the order which this Court proposes to pass.

5 Accordingly, without commenting upon the merits of the case, the present writ petition is disposed of with a direction to respondent No.3General Manager, Haryana Roadways, Bhiwani, District Bhiwani, Haryana, to decide the legal notice dated 02.02.2025 (Annexure P-1) submitted by the petitioners and to pass a speaking and reasoned order thereupon in accordance with law within a period of four months from the date of receipt of certified copy of this order.
