The present revision petition h a s been filed against the judgm e nt of conviction a nd order on quantum of senten c e, both dated 19.09.2018, pass e d by the Court o f learned Sub Divisional Judicia l Magistrate, Pehowa in case titled as State vs. Jagroop Singh and others , a r ising out of FIR No. 131 d ated 03.05.2013, registered under Sections 148, 323, 324 and 326 read with Section 149 of the IPC at Police Station Pehowa , whereby, while acquitting th e coaccused, th e petitioners were held guilty fo r commission of offences punis h able under Sect i ons 323, 324 and 326 read w ith Section 34 of IPC and were sentenced t o undergo simple imprisonment for maximum 03 years with fi n e; as well as aga i nst the judgment dated 27.02. 2 025, passed by the Court of le a rned Additional Sessions Judge, Kurukshetra, w hereby the aforesaid judgme n t of conviction p assed by the learned trial Co u rt was upheld and the appeal was dismissed.

Today, learned counsel for th e petitioners has made a statement so as not to pr e ss the present revision against t h e judgment of conviction, pass e d by the learned trial Court, as well as the judg m ent passed by the learned app e llate Court. Lear n ed counsel confines his prayer against the order of sentence o n ly. It is further s u bmitted that the petitioners ar e not the previous convicts no r any other case i s pending against them and so l ooking into these circumstance s , the sentence of the petitioners may be reduce d to the period already undergo n e by him.

Learned State Counsel has n o serious objection to the aforesaid prayer. He h as filed custody certificates, as per which, petitioner Jagroop S ingh has alread y undergone actual sentence o f 06 months and 27 days, wh e reas petitioner S u bhash has undergone actual se n tence of 05 months and 11 day s , out of total sen t ence of 03 years as awarded by the learned trial Court and upheld by the learned a ppellate Court and they are not involved in any other case.

After hearing the counsel for t h e parties, I uphold the judgme n ts of conviction p assed by the Courts below as t h e same are based on appreciati o n of prosecution evidence, proving guilt of the p etitioners, however, considering the fact that th e petitioners have faced the ag o ny of protracted trial and they have already un d ergone aforementioned senten c e and are not involved in any o ther case, whic h shows that they have improve d their character and have joined the mainstream of the society, the order on qua n tum of sentence dated 19.09.2 0 18 is modified to the extent that the same is red u ced to the period already unde r gone by them. H o wever, the fine imposed upon t he petitioners is upheld. The pe t ition stands disp o sed of.

The petitioners are directed to be released from custody forthwith, if not requi r ed in any other case, on depositing fine as imposed by the le a rned trial Court.

Since the main petition stands disposed of, pending applicati o n, if any, shall a l so be treated as disposed of.
