17.08.2024 under Sections 103(1), 109, 118(1), 118(2), 190, 191(3) of BNS, 2023 registered at Police Station Lakho Ke Behram, District Ferozepur.

The FIR in the present case was registered on the basis of the statement made by Satnam Singh son of Tarsem Singh and the same has been reproduced below:-

Statement of Satnam Singh son of Tarsem Singh resident of Dod. Aged about 30 years. Mobile No.78886-48858. Stated that I am the resident of above said address and doing the work of labourer. We are five brothers and sister. I am elder one. Younger to me is Meet. Younger to him my brother Lovepreet Singh alias Labhu. My two sisters namely Manpreet Kaur and Gagandeep Kaur. My two sisters are married. At about 06:30/06:45 PM I and my father Tarsem Singh were sitting in the home, on that the backside of our house the niece of my father namely Manga Singh son of Jasvir Singh resided. On hearing noise from his house regarding quarrel, I and my father Tarsem Singh son of of Balwant Singh were also gone to their house. We saw that Akash son of Kala resident of Mehma, Binder Kaur wife of Satnam Singh and Lakshdeep Singh son of Satnam Singh resident of Makhu Ferozpur City, Aman Kaur wife of Gurpreet Singh alias Bittu, Sukhpreet Kaur daughter Gurpreet Singh alias Bittu resident of Haraz Verka now resident of Makhu Ferozpur City and Badal alias Anshu friend of Akash resident of Kumar Wali Gali, Patianwali Basti, Ferozpur City, were quarrel with Manga Singh etc. at the spot Sahab Singh son of Jasvir

Singh and Sukhdev Singh son of Jasvir Singh resident of Dod were also present. They all were reached near the society of village by quarreling with each other, where I, my father Tarshem Singh, Sahab Singh son of Jasveer Singh were tried to make them understand but they all quarrel with us. Meantime Badal alias Anshu took the Kirch and Akash extorted to Badal on that Badal alias Anshu gave Kirch upon my father namely Tarsem Singh, which hit upon the left side of his waist, then Badal alias Anshu has gave two attempt of his Kirch upon Sahab Singh which hit upon his neck and upon his chest then Badal alias Anshu gave his Kirch upon Sukhdev Singh which hit upon his back, after some time my father Tarsem Singh had died on the spot due to receive injuries by Kirch then we took dead body of my father at home and handover to the mortuary of the Civil Hospital Ferozpur. Sahab Singh and Sukhdev Singh sons of Jasvir Singh resident of Dod who become injured were taken by Amanpreet Kaur wife of Sukhdev Singh and Sukhwinder Singh son of Tota Singh resident of Dod in the car of Sukhwinder Singh and admit to Guru Gobind Singh Medical College Faridkot. Bhagwan Singh had been taken to Aman Kaur but from last some time he has not gone to her. Due to that they have a dispute. Bhagwan Singh who is brother-in-law of Manga Singh, Akash son of Kala resident of Mehma is friend of Sukhpreet Kaur and Badal alias Anshu who is friend of Akash. Aman Kaur and Sukhpreet Kaur are mother and daughter. At that time they were residing at the house of Binder Kaur on rent basis. the house of Bhagwan Singh at Village Haraz Verka, but they did not found at home. Due to that they have suspected that Bhagwan Singh might be in the house of Manga Singh and they all by the Verna Car Colour Black and by one motorcycle and one Activa they came at our village at the house of Manga Singh then they gone to the Chowk of village. Where they all in connivance with each other and with the consent of each other has murdered to my father Tarsem Singh by giving injuries and they also injured to Sahab Singh, Sukhdev Singh sons of Jasvir Singh resident of Dod. The reason behind is that Aman Kaur who earlier having relation with Bhagwan Singh but from last some time Bhagwan Singh has left him due to that they have dispute with said Bhagwan Singh, they have suspect that Manga Singh who is brother in law (Jija) of Bhagwan Singh has not allowed him to go to Aman Kaur and he took him into his house. Due to that Akash, Bhinder Kaur, Lakshdeep Singh, Aman Kaur, Sukhpreet Kaur, Badal alias Anshu has done the all incident. Legal action should be taken against them. Learned counsel for the petitioner(s) submit that the petitioner(s) were named in the FIR, but no specific role has been assigned to them. Even injuries were caused to Sahib Singh. Learned counsel further submit that the petitioner(s) had neither caused injuries to Tarsem Singh, since deceased, as well as Sahib Singh and Sukhdev Singh, both injured. As per the CCTV footage of the occurrence, both the petitioner(s) were simply present at the place of

occurrence and were not part of the unlawful assembly, which had committed the crime. Even otherwise, the alleged motive was also not against the petitioner(s) and they had no reason to participate in the occurrence. Learned counsel further submit that Binder Kaur was arrested in the present case on 18.08.2024, whereas Lakshdeep Singh was arrested on 19.08.2024 and are in custody since then. Learned counsel further contend that the injured witnesses namely Sahib Singh and Sukhdev Singh have been examined and the custody of the petitioner(s) would not serve any useful purpose.

On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner(s) on the ground that serious allegations have been levelled against the present petitioner(s) and they do not deserve the concession of bail by this Court.

I have heard learned counsel for the parties and perused

the record.

As per the admitted case of the prosecution, both the petitioner(s) were simply present at the place of occurrence and the prosecution is yet to lead evidence before the trial Court with regard to their involvement in the crime. Both of them have are stated to be in custody for the last about 11 months and only 02 witnesses have been examined so far. Thus, the further custody of the petitioner(s) will not serve any useful purpose.

Without commenting on the merits of the case, the present petitions are allowed. The petitioner(s) are ordered to be released on bail pending trial on their furnishing bail bonds and surety to the satisfaction of the concerned trial Court/ Duty Magistrate/Chief Judicial Magistrate.
