On a call given by the Punjab and Haryana High Court Bar Association, the Members of the Bar are abstaining from work w.e.f. 15.12.2025. Position is same even today.

In the present case, on 12.12.2025, following order was passed:-

“1. The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of interim regular bail to the petitioner for a period of eight weeks from the date of release, on account of taking care of his pregnant wife, who has been booked in a criminal case arising out of First Information Report, as detailed here-under:-

Today, ASI Daljit Singh, ANTF, Ferozepur, who is appearing inperson, files status report dated 17.12.2025, in Court today, which is taken on record. Office to tag the same at appropriate place.

Let a copy thereof be handed over to the opposite counsel during course of the day.

Paragraph Nos. 7 to 9 reads as under:-

“7. That the statement of Sumanjeet Kaur, sister of petitioner was also recorded and her statement she stated that she was married with Krishan Singh, who died on 18.3.2025 due to heart attack. She stated that she had two children and now she is residing with her parents. She further stated that Harmandeep Kaur is now pregnant and her treatment is going on at Civil Hospital Zira and her mother is suffering from knee problem and her father is doing labour work and as such there is nobody to look after Harmandeep Kaur in that situation. The translated copy of statement of Sumanjeet Kaur is annexed as Annexure R-2/T. The statement of Sukhdev Singh, father of petitioner was also recorded, who also deposed on the same lines as that of Sumanjeet Kaur and Harmandeep Kaur.

That it is most respectfully submitted that the common statement of Sarpanch of village Shian Pari duly identified by Swaran Singh and Baljinder Singh was also recorded and as per the said statement, the petitioner is permanent resident of the above said village and the wife of the petitioner is pregnant. It was also stated in the panchayat Nama that the tentative date of delivery was given of December by the Doctors and the petitioner is confined in jail. It was also stated that the mother of the petitioner is not well and his father is doing labour work and the petitioner can look after his wife, if released on parole. They also took the responsibility of interim bail of petitioner. The translated copy of common statement is annexed as Annexure R-3/T.

That it is further submitted that the medical record of wife of petitioner was also obtained and as per the said record, she is getting treatment from Civil Hospital, Zira vide CR no. 1300312500440035. As per medical record the date of delivery is 04-01-2025 +/- 02 Weeks. ”

From the aforementioned status report, it is evident that the wife

of the petitioner, namely Harmandeep Kaur , is pregnant and, as per the

medical record, her expected date of delivery is 04.01.2026 ± two weeks .

Apart from the petitioner’s aged parents, there is also a widowed sister of the petitioner residing in the same household.

Considering the aforesaid circumstances in their totality, and particularly the fact that at this crucial stage the wife of the petitioner would require the care and support of her husband, this Court deems it appropriate to grant interim regular bail to the petitioner for a period of eight weeks .

Accordingly, petitioner – Arshdeep Singh alias Arsh , be released on interim bail in this case up-till 18.02.2026 , subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/Chief Judicial Magistrate/Illaqa Magistrate/Duty Magistrate concerned.

Needless to mention here that the petitioner shall surrender back to the Jail Authorities on 18.02.2026 at or before 05:00 P.M. , in compliance to the directions passed by this Court.

With aforementioned terms, present petition is disposed of . Pending misc. application(s), if any, also stand(s) disposed of. However, for the purpose of ascertaining whether the aforesaid directions passed by this Court have been duly complied with or not, the matter be listed again on 23.02.2026 .
