Satnam Singh and Anr. Vs State of Punjab

The present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioners jointly seeking grant of regular bail in case bearing FIR No.201 dated 07.10.2022, registered under Sections 379-B, 383, 34 IPC at Police Station Sadar Kharar, District SAS Nagar, Mohali.

As per the allegations, on the evening of 07.10.2022, Sh. Dilbagh Singh father of the complainant – Harkiran Singh was going for a walk, when two persons snatched his wallet containing cash amount of Rs.3700/-. They were chased and caught along with a Honda City vehicle. Their custody was handed over to the police. The aforementioned FIR was registered. Investigation proceedings were initiated. The petitioners were formally arrested.

It is argued by learned counsel for the petitioners that they are in custody since 18.12.2024. Investigation has been completed. Challan stands presented and the trial is likely to take considerable time to conclude. Their further incarceration would not serve any useful purpose. Petitioner No.1 – Satnam Singh is involved in three more cases whereas petitioner No.2 – Lovepreet Singh is involved in two other cases. Their involvement, as such, does not disentitle them for seeking benefit of regular bail. It is, therefor, argued that they deserve to be released on bail.

Learned State counsel has advance notice of the petition and has filed custody certificate and is ready to argue the matter and has submitted that the petitioners have criminal antecedents. Therefore, if released on bail, there are chances of their absconding or committing similar offences. It is, therefore, argued that they do not deserve to be extended the benefit of bail. 6. I have heard rival submissions made by learned counsel for the

The petitioners are in custody since 18.12.2024. Investigation stands concluded. Trial will take time to conclude. No useful purpose would be served by detaining them in custody anymore. It is well settled preposition of law that the bail is the rule and jail is an exception. They cannot be denied bail because of their involvement in some other cases.

Keeping in view the above facts and circumstances, I am of the considered that the petition deserves to be allowed. Accordingly the same is allowed and the petitioners are ordered to be admitted to bail subject to their furnishing personal/surety bonds to the extent of two sureties to the

satisfaction of learned trial Court/learned Chief Judicial Magistrate/Duty Magistrate concerned. They shall appear before the concerned Police Station once on the first Monday of every month. They shall disclose their present as well as permanent address before the learned trial Court at the time of furnishing of bonds and shall also give copies of their Aadhar Card and PAN card, if any.
