The present petition has been filed for grant of anticipatory bail to the p etitioner in case bearing DDR N o.04 dated 25.05.2025, under Sections 118(1), 126(2), 115(2), 351(2), 1 9 1(3) and 190 of BNS (Section 117(2) of B NS added later on), in FIR No. 3 3 dated 25.05.2025, registered at Police St a tion City Ahmedgarh, District M alerkotla. 3. On 03.12.2025, this Court pas s ed the following order:

“Learned counsel int e r alia contends that the petitioner has been falsely implicated in the present case on account of him being a friend of co-accused, namely, Mohd. Imran whose fat h er had registered FIR No.33 dated 25.05.2025 against the complainant party. The petitioner has neither b e en named in the DDR nor attributed any overt act, rather his name cropped up during investigation on 1 3 .09.2025. He is not involved in any other case , rea d y and willing to join the investigation as and whe n required by the investigating agency and will cooperate. Notice of motion. Punjab, accepts notice on behalf of respondent-State. Meanwhile, the petitioner is directed to join the investigation on or before 10.12.2025. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) of BNSS, 2023.

However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated. Adjourned to 18.12.2025.”

ASI Jaspal Singh, Investigating Officer appears and states

that the petitioner has joined the investigation and cooperating with the same. He also submits that at this stage, the petitioner is not required for further custodial interrogation.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 03.12.2025 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

6. However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
