Th i s petition has been filed unde r Section 482 Cr.P.C. seeking quashing of s u pplementary final report date d 12.05.2018 under Sections 148/149/323/32 4 /326/506 of IPC (Annexure P -1) arising from FIR No.210 dated 27.10.2 0 17 under Sections 148/149/ 3 23/324/326/452/506 of IPC registered at Police Station Chhapar, District Y amuna Nagar (Annexure P-2) along with all subsequent proceedings arisi n g therefrom on the basis of compromise (A n nexure P-3).

Th e following order was passed on 04.03.2024 :-

“1. Through the instant peti t ion, prayer is made for quashing of the supplementary final r eport dated 12.05.2018, under Sections 148, 149, 323, 324, 3 2 6, 506 of the IPC (Annexure P-1) [arising out of version case i n FIR No.210 dated 27.10.2017, under Sections 148, 149, 323, 324, 326, 452, 506 of the IPC, registered at P.S. Chhapar, Dis t rict Yamuna Nagar], on the basis of a Compromise Deed (Annexu r e P-3).

3. On asking of the Cour t , Mr. Bhupender Singh, D.A.G., Haryana, accepts notice on beh a lf of the respondent No.1-State. 4. Mr. Sidhant Bhonsle, Advocate, who records his appearance on behalf of the r espondent No.2, under a validly executed Vakalatnama institute d before this Court today, accepts notice on behalf of the respo n dent concerned and admits the factum of compromise between t he parties.

In the light of admission made on behalf of learned counsel for respondent No.2, the partie s are directed to appear before the learned Trial Court/Illaqa Mag i strate, within a month from today, to get their respective statemen t s recorded regarding compromise and after recording their respe c tive statements, the learned Trial Court/Illaqa Magistrate is directed to send the same along with its report, regarding the genuinene s s of compromise, on or before the date fixed in the instant petiti o n specifically with regard to the following facts:-

1. Number of persons ar r ayed as accused in the FIR.

2. Whether any accused i s proclaimed offender.

¶24

3. Stage of the trial/proc e edings.

¶25

4. Whether the compr o mise is genuine, voluntary and without any coercion or u ndue influence.

5. Total number of victi m s and their names.

¶27

6. It is made clear that complainant/private respondent should also appear in person b ef ore the learned trial Court/Illaqa Magistrate to get his statement r ecorded regarding compromise. 7. To come up on 16.04.20 2 4 for awaiting the report. 8. The State counsel is als o directed to verify the factum of compromise by the date fixed.

9. A copy of this order be sent to the learned Trial Court/Illaqa Magistrate for co mp liance.”

In c ompliance of the aforesaid or d er, a report has been received

from the conc e rned jurisdictional Court that the compromise between the parties is genuine and arrived at without a n y pressure or coercion from anyone.

Hon’ble Supre m e Court in Narinder Singh and others vs. State of Punjab and another, (2014) 6 SCC 46 , and Shakuntala Sawhney (Mrs) Vs. Kaushalya (Mrs.) and others (1980) 1 SCC 63 and Full Bench of this Court in Kulwinder Singh Vs. State of Punjab 2007 (3) RCR (Crl.) 1052 , this petition is allowed and supplementary final report da t ed 12.05.2018 under Sections 148/149/323/32 4 /326/506 of IPC (Annexure P -1) arising from FIR No.210 dated 27.10.2 0 17 under Sections 148/149/ 3 23/324/326/452/506 of IPC registered at Police Station Chhapar, District Y amuna Nagar (Annexure P-2) and all consequ e ntial proceedings arising out o f the same are quashed, qua the
