The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail in case FIR No.0006 dated 06.08.2024 registered under Sections 406, 420 of IPC and Section 66(D) of Information Technology Act, 2000, at Police Station Cyber Crime, District Sangrur.

After hearing learned counsel for the parties, the following order was passed by this Court on 14.02.2025:-

“During the course of hearing, learned counsel for the petitioner submits that the petitioner has already returned a sum of Rs.7 lacs to the complainant. The learned counsel for the petitioner has handed over a draft bearing No.366556 dated 13.02.2025, drawn by Bank of Baroda for a sum of Rs.3 lacs to the learned counsel for the complainant in Court today. A photocopy of the same is annexed as Mark ‘A’. Learned counsel further submits that the petitioner shall return the entire amount to the complainant within a period of 4 months from today and he is ready to amicably resolve the dispute with him.

Learned counsel appearing on behalf of the respondent/ complainant, on instructions from his client, who is present in the Court, submits that he has no objection to the prayer made by learned counsel for the petitioner. In case, the entire amount is paid by the petitioner, he has no objection to quash the FIR in the present case.

With the consent of the parties, the matter is referred to Mediation and Conciliation Centre of this Court to finalise the terms of the compromise. The parties are directed to appear before the Mediation and Conciliation Centre of this Court on 03.03.2025.

In the meantime, the petitioner is ordered to be released on interim bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.”

After, the matter was referred to Mediation and Conciliation

Centre, the parties could be arrived at a compromise. However, the learned counsel for the petitioner made repeated requests for adjournment to comply with the order passed by this Court.

Even on 20.05.2025, the following order was passed by this

“Learned counsel for the petitioner has assured the Court that the entire payment shall be made by the petitioner on or before the next date of hearing.

Adjourned to 15.07.2025.

In the meantime, the petitioner is directed to make the entire payment to the complainant in the present case, in compliance of the settlement dated 12.03.2025, which have been duly signed by both the sides.

In case, the entire payment is not made on or before the next date of hearing, the present petition shall be deemed to be dismissed. ”

Today, I have heard the learned counsel for the parties and perused

the record.

During the course of hearing, Learned counsel for the complainant submits that the petitioner has not complied with the interim order passed by this Court and only Rs.5 lacs has been paid by the petitioner and has not paid the remaining amount of Rs.15 lacs to the complainant.

Learned counsel for the petitioner also submits that he could not make the payment due to some personal difficulty. However, he admits that he had undertaken to make the entire payment to the complainant in the present case by the next date of hearing.

Since, the petitioner has not complied with the undertaking given by him before this Court, he is not entitled to any relief from this Court. Consequently, the present petition is ordered to be dismissed. The petitioner is directed to surrender before the trial Court/Duty Magistrate, within a period of three days from today, failing which, non-bailable warrants will be issued against him for arresting.

Thus, in view of the statements made above, the present petition is ordered to be dismissed.
