Present petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to the petitioner in case FIR No.209 dated 16.9.2024, under Sections 406 and 420 of IPC, registered at Police Station Model Town, District Hoshiarpur.

2. On 21.5.2025, the following order was passed:

Learned counsel for the petitioner has placed on record the duly sworn affidavit of petitioner Navdeep Singh dated 21.05.2025 wherein he has mentioned that as per the compromise dated 19.05.2025, he has agreed to pay amount of Rs.8.5 lakh to respondent No.2 and in this regard he has already issued three cheques, qua which he is duly bound to get the same released for payment to respondent No.2. Copy of affidavit has been handed over to learned counsel for respondent No.2 who after perusing the same has expressed satisfaction. Copy of compromise deed dated

3. Accordingly, the three cheques kept in a sealed cover placed on the file are ordered to be handed over to respondent No.2 against proper receipt and identification. It is again reiterated that the petitioner will be bound to get the aforesaid cheques duly honoured as and when presented in terms of undertaking.

In the meanwhile, keeping in view the above facts and circumstances, the petitioner is hereby directed to join investigation within seven days from today and in the event of his arrest, he is ordered to be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 482 (2) of BNSS, 2023.

Learned State counsel, on instructions, submits that the petitioner has joined investigation and is no longer required for custodial interrogation.

In view of the above, the instant petition is allowed. The interim order dated 21.5.2025, passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS.

Needless to say that the petitioner as also accused shall remain bound by the settlement having agreed between the parties.

This order should not be treated as “blanket” order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.
