Th e instant first petition has been fi led under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the petitioner in c a se bearing FIR No.81 dated 2 2.06.2025 registered under Section 109, 115(2), 126(2), 191(3), 190, 2 2 1 of the Bharatiya Nyaya Sanhita, 2023, S ections 25, 27 of the Arms Ac t , 1959 and Section 61 of the Punjab Excise A ct, 1914 at Police Station Lohi a n, District Jalandhar (Rural). 2. liquor contractors Raman Kumar and Rajesh Kumar of Shahkot for the last 25–26 years. It is alleged that on 22.06.2025, at about 9:00–9:30 a.m., the complainant, along with Harjinder Singh, Gurpreet Singh, Gourav, Nirmal Singh, Baldev Singh (Incharge, Jalandhar Excise Staff) and gunman Randev Singh, was travelling in a Bolero Camper bearing registration No. PB-08EZ-4665 from Kamalpur towards Fatehpur. Upon reaching village Asmailpur near the river Sutlej, they noticed six plastic tarpaulins lying near the barrage of the river. On inspection, the tarpaulins were found to contain lahan, each weighing approximately 200 kilograms. The raiding party destroyed the said lahan by throwing it into the river. Thereafter, when the complainant party came out of the river, they found several persons standing on the riverbank, namely Gurpreet Singh armed with a khanda loha, Jinder Singh armed with a stick, Gurmit @ Gami armed with a baseball bat, Guddu armed with a stick, Premi armed with an iron rod, Shindu armed with a stick, Buta armed with a stick and Raju. Raju exhorted the others to teach the complainant party a lesson for damaging the tarpaulins, whereupon Gurpreet Singh inflicted a blow with the khanda loha on the left side of the complainant’s head. Jinder Singh struck the complainant on his left shoulder with a stick, Gurmit @ Gami gave a baseball bat blow on the complainant’s left elbow and Guddu inflicted a stick blow on his right elbow. It is further alleged that when Harjinder Singh attempted to intervene and rescue the complainant, Premi struck him on the back with an iron rod, Shindu inflicted a stick blow on his left thigh and another blow on the knee of the complainant and Buta gave a stick blow on the right leg of Harjinder Singh. fired a shot in the air, followed by another shot aimed towards the foot of a member of the raiding party, who, out of fear, jumped back into the river. Upon the complainant party raising an alarm, all the assailants fled from the spot after extending threats of dire consequences. On the basis of the aforesaid statement of the complainant, the present FIR came to be registered.

Learned counsel appearing on behalf of the petitioner contends that the petitioner has been falsely arrayed as an accused in the present case. It is submitted that no injury suffered by any of the parties can be categorised as dangerous to life and that the injuries are of a simple nature. Learned counsel further submits that the petitioner has been in custody since 07.07.2025. It is also submitted that the investigation in the present case stands completed, the charges are yet to be framed and in view of the number of witnesses and the stage of proceedings, the conclusion of the trial is likely to take a long time. He further submits that other co-accused Rajwinder Singh @ Raju has already been granted concession of anticipatory bail by this Court vide order dated 10.09.2025 passed CRM-M47316-2025 titled as ’ Rajwinder Singh @ Raju Vs. State of Punjab ‘.

Learned State Counsel does not dispute the aforesaid facts.

I have heard learned counsel appearing on behalf of the respective parties and have gone through the documents appended along with the present petition.

In view of the facts noticed above and taking into consideration that co-accused Rajwinder Singh @ Raju has already been granted concession of anticipatory bail by this Court vide order dated 10.09.2025 passed CRM-M-47316-2025 titled as ’ Rajwinder Singh @ Raju Vs. Punjab ‘ as well as the stage of the trial, I deem it appropriate to allow the present petition.

The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned.

It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witnesses in any manner directly or indirectly.

¶31

The observation made hereinabove shall not be construed as an expression on the merits of the case and the Trial Court shall decide the case on the basis of available material.
