While reading out the co n tents of the FIR, learned counsel for the petitioners sub m its that the total disputed amount, as alleged by the com p lainant, is Rs.23 lakhs. It is further submitted that an a m ount of Rs.5 lakhs has already been returned by p e titioner No.1 – Kavita through bank transaction, a s also reflected in the compromise deed dated 20.03.2 0 24 (Annexure P-2).

Referring further to the allegations in the FIR, learned counsel points out that the complainant has also admitted of receiving an additi o nal amount of Rs.6 lakhs in cash, which brings the total a dmitted amount to Rs.11 lakhs, apart from the car belo n ging to petitioner No.1, which is also in possession of t h e complainant.

It is further submitted th a t petitioner No.1 – Kavita is now all alone, having been deserted by her husband following the registration of t h e FIR, and is therefore unable to meet out the liabilitie s independently.

Learned counsel states that the petitioners are ready and willing to join th e investigation and fully cooperate with the investigatin g agency, and accordingly, prays for the grant of anticipato r y bail.

On advance notice, Mr. N eeraj Madaan, Sr. DAG, Punjab, appears on behalf of respondent–State and seeks time to file a reply.

5. Adjourned to 26.09.2025 .

Taking into consideratio n that the matter arises out of a monetary dispute, that th e petitioners are women, that the husband of petitioner N o.1 is yet to be arrested, and that a part payment of Rs. 1 1 lakhs has already been received by the complainant as per submissions of learned counsel for the petitio n ers, this Court deems it appropriate to grant interim pro t ection to the petitioners.

Accordingly, the petition e rs are directed to join the investigation as and when re q uired to do so by the Investigating Agency. In the e vent of their arrest, the petitioners shall be released o n interim bail, subject to their furnishing bail bonds t o the satisfaction of the Arresting Officer. The petition e rs shall also be abide by all the conditions laid down u nder Section 482(2) of BNSS, 2023 (earlier Section 43 8 (2) Cr.P.C.).

Besides, it is directed th a t petitioners would hand over their passport to the In v estigating Agency or to Court concerned, if the possess. Otherwise, would submit an affidavit, disclosing the fac t that they do not possess any passport.

It is also directed that b e fore leaving country any time during trial, petitioners w o uld seek prior permission to the Court.”

Continuing his submissions, learned counsel for the petitioners c o ntends that in compliance of t h e order dated 09.07.2025, passed by t h is Court, petitioners have joined the investigation, and have fully c o -operated. Therefore, he pray s for confirmation of the said interim a nticipatory bail order.

Learned State counsel confirm s the said averment made by counsel for the petitioners of joini n g the investigation on 18.09.2025 b y the petitioners, and submits that as of now, custodial interrogatio n of the petitioners are not re q uired for the purpose of investigatio n .

Since, petitioners have alread y joined the investigation and custodi a l interrogation is no more requ i red; ad-interim bail order dated 09.07 . 2025, passed by this Court i s hereby made absolute. Accordingly , present petition is allowed.
