T h e instant petition has been f i led under Section 528 BNSS for quashing of FI R No.0001 dated 13.08.2022 re g istered under Section 498-A IPC at Women Police Station, Sangrur, District Sa n grur (Annexure P-1) and all o ther consequential p roceedings arising therefrom o n the basis of compromise d ated 02.11.2022 (A n nexure P-2).

L e arned State counsel on instructions from ASI Gurdev Kaur sub m its that initially th e FIR was registered against the petitioner only but thereafter, o n an application fil e d by the prosecution under S ection 319 Cr.P.C., six additional accused have b een summoned to face trial u nder Section 406 and 498-A I PC, however, the i n stant petition has been filed o n ly on behalf of one accused i.e . the petitioner-husb a nd and thus, in view of law l a id down by the Division Benc h of this Court in R akesh Das Vs. State of Harya n a and another passed in CR M -M48043-2023 o n 12.11.2024 (Neutral Citation 2024:PHHC:147654-DB), the in s tant petition seekin g quashing of FIR based on partial compromise is not maintaina b le.
