Vikasdeep Singh Alias Akash Vs State of Punjab

The Prayer in this petition under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 is for the grant of regular bail in case FIR No.17 dated 14.03.2024 under Sections 307, 148, 149 Ipc and Sections 25/27 of Arms Act registered at Police Station City Zira, District Ferozepur. 2. The present FIR came to be registered at the instance of Sukhdev Singh and reads as under:-

“ Statement of Sukhdev Singh s/o Dalip Singh s/o Bali Ram r/o Mohalla Chah Beriyan, Mallo Ke Road, Zira. P.S.City Zira, aged about 47 years, Mobile No. 98145-09160, stated that I am resident of the above said address and I am 7th pass and I work as a labourer. We are 3 brothers. My elder brother is Raj Kumar and younger brother is Gurbachan Singh who had died. My both brother's family stays together with me under one roof only, and

my daughter Amandeep Kaur w/o Mangal Kumar also resides in her house near us. She has 03 children and the younger to the girls is a boy named Rahul. On 13.03.2024, 1 alongwith my nephew Vishal son of Gurbachan Singh, Saraj Kumar son of Raj Kumar and my grandson Rahul son of Mangal Kumar residents of Mohalla Chah Berian, Mallo Ke Raod, Zira were out of our house and were standing opposite Primary School Zira and lights were on and time would be about 08-15 pm in the night. Then Akashdeep Singh alias Akash son of Charanjit Singh r/o Village Dhandian armed with 12 bore, Navdeep Singh alias Navi son of Kuldeep Singh r/o Village Booh, P.S. Harike-who had come to his maternal grandparents was empty handed and Manpreet Singh alia Manna son of Nachattar Singh r/o Village Shahwala, armed with Kaapa, step down from one white color swift car and I am already known to them. Then two unknown persons came out of one Alto Car and one among them was having Sword in his hand. 04 more unknown persons also came there on two motorcycles. Both two pillion riders of the both motorcycles were having slugger (baseball bat) in their hands and rest of the unknown persons were empty handed. Navdeep Singh alias Navi and Manpreet Singh alia Manna among them have raised lalkara that let them teach a lesson for fighting with us. My nephew tried to run inside the house after getting frightened, then Akashdeep Singh alia Akas, with intent to kill him, opened a fire with his hand held 12boreson my nephew Vishal which hit him on the backside of his head.My nephew, while ensanguined, ran towards my house. Then Navdeep Singh alias Navi snatched 12 Bore rifle from Akashdeep Singh @ Akash and opened fire towards my grandson Rahul, with intent to kill him and the same hit him on

the right cheek and then we all ran inside our house. On seeing the Mohalla residents gathered, all accused ran away from the spot alongwith their weapon on their both vehicles and both motorcycles. Then my son Ajay Kumar and my grandson Vishal Kumar arranged for the conveyance and took Vishal and Rahul and got admitted to the Civil Hospital Zira. Doctor Sahib referred them to Medical College, Faridkot. We were not having arrangement of money, so we did not get admitted at Medical College Faridkot. Now we are deciding to get treatment from private Doctor. This entire incident has been witnesses by me and my nephew Saraj Kumar Reason of enmity is on the eve of Shivratri, my nephew Vishal and grandson Rahul had altercation with Akashdeep Singh @ Akash etc. near Bus Stand, Zira on some mobile number. Due to which, they with intent to kill my nephew Vishal and my grandson Rahul, opened straight fire on them. Today I and my nephew Saraj were coming to your for getting our statement recorded and you met us at the turn of Civil Hospital Zira. Suitable legal action be taken against the. Statement got recorded, heard and is correct. Sd/ Sukhdev Singh. ”

The learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case. Be that as it may, Sukhdev Singh has been examined as PW-1, Saraj as PW-2, Rahul as PW-3 and Vishal injured as PW-4. None of them have supported the prosecution case. As the petitioner is in custody since 25.04.2024 and all the material witnesses have turned hostile, he may be granted the concession of bail.

The Counsel for the complainant has not disputed the factual position and states that he has no objection if the petitioner is granted the concession as prayed for.

The State counsel on the other hand contends that the petitioner and one Navdeep a juvenile accused fired shots at the injured. Therefore, he was not entitled to the concession of bail. He however, concedes that all the material witnesses stands examined and have not supported the prosecution case.

I have heard the learned counsel for the parties.

Admittedly, the material witnesses including the injured ones have not supported the prosecution case. It would be a moot point during the course of the Trial as to whether the remaining evidence is sufficient to establish the culpability of the petitioner and his co-accused. He is stated to be in custody since 25.04.2024. The Trial is otherwise not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required.

Thus without commenting on the merits of the case, the present petition is allowed and the petitioner- Vikasdeep Singh @ Akash son of Sh. Charanjit Singh is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned.
