This petition under Section 528 of Bhartiya Nagarik Suraksha Sanhita, 2023 (BNSS, 2023) has been filed seeking direction to the official respondent(s) to reinstate the petitioners and her daughter in her matrimonial home as they have been forcibly thrown out by respondents No.4 & 5.

At the very outset, learned counsel for the petitioners has submitted that the petitioners have filed a complaint/representation (Annexure P2) before respondent No.2 raising their grievances as mentioned in the present petition but the same has not yet been considered and no action has been taken thereupon. He further submitted that at this stage, the petitioners would be satisfied if, appropriate directions are issued to respondent No.2, to consider and decide the aforesaid complaint/representation filed by the petitioners and to take necessary action thereupon.

In view of the limited prayer made by the petitioners and without commenting on the merits of the case, the present petition is disposed of at this stage with a direction to respondent No.2 to consider and decide the aforesaid complaint/representation (Annexure P2) of the petitioners expeditiously, by passing a speaking order in accordance with law.

Needless to say, if any threat is found to the petitioners, the official respondents would provide them adequate security in order to protect their life and liberty.
