On 15.12.2025, this Court had passed the following order:-

“Learned Senior cou n sel inter alia contends that initially an inquiry was con d ucted which on an application, was transferred, on the p remise that the wife of the complainant was a colleagu e of the said officer as averred in para 4(x), whereupon the other senior officer opined that it was a dispute of civil nat u re. On an another application by complainant, the form e r officer again recommended registration of FIR, howev e r, DA (Legal) vide his report, Annexure P4, came to the c onclusion that it was of civil nature and there was civi l suit and proceedings under Section 138 NI Act tha t had been initiated by the complainant. The civil s uit for injunction filed on 17.05.2024, even before t h e date fixed for execution of sale deed being 30.06.2024, but interim injunction was not

granted, as the Court observed that the opposite party was required to be heard and thus, only notice was issued for 29.05.2024. However, an application filed by complainant, the same was got preponed and withdrawn it on 20.05.2024. Correct agreement to sell is stated to be Annexure P9, as per which, the sale consideration is Rs.1,35,00,000/- while the complainant is said to have forged an agreement Annexure P10 wherein an amount mentioned is Rs.1,00,00,000/- out of which allegedly Rs.20,00,000/- paid in cash by him. Wife of co-accused in whose account also some amount is said to have been received, was granted anticipatory bail by this Court, after recording the contention with regard to the dispute being civil in nature. He is ready and willing to join the investigation as and when required by the investigating agency and will cooperate.

At the asking of the Court, Ms. Gagandeep Kaur, DAG, Punjab, accepts notice on behalf of respondent-State and Mr. Munish Gupta, Advocate, appears on behalf of the complainant and made their submission in opposition.

Meanwhile, the petitioner is directed to join the investigation on or before 18.12.2025. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) BNSS.

However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated. Adjourned to 23.12.2025.”

Learned Senior Counsel submits that in pursuance of the afore-mentioned order, the petitioner has not only joined investigation but also fully cooperated with the investigating agency. He further submits that in case the investigating agency requires the petitioner to appear, he shall make himself available without demur.

Learned State counsel on instructions from Inspector Sukhwinder Singh Gill affirms the factum of joining the investigation by the petitioner and cooperating with the investigating agency. He also submits that at this stage, the petitioner is not required for further

custodial interrogation.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petition filed by the petitioner is allowed and the order dated 15.12.2025 granting interim bail to him, is hereby made absolute, subject to compliance of conditions as specified under Section 482(2) of BNSS, 2023.

6. However, it is made clear that if the petitioner fails to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to him.
