Bijender Singh Vs State of Haryana

The jurisdiction of this Court has been invoked under Section 482 BNSS for directing the Arresting/ Investigating Officer to release the petitioner on bail in the event of his arrest in case/ FIR No. 0040 dated 27.2.2025, under Sections 420, 406, 408, 120-B IPC & Section 3 of The Haryana Protection of Interest of Depositors in Financial Establishment Act, 2013 & 21, 23 of Banning of Unregulated Deposit Schemes Act, 2019, Police Station Sanoli, Panipat, District Panipat (Haryana).

In compliance to the order dated 03.04.2025, the petitioner has joined the investigation and an affidavit of Shatrujeet Kapur, IPS, Director General of Police, Haryana, has been filed in CRWP-3624-2025, wherein para 4, it has been stated as under:-

“That it is submitted that in view of observations made by this Hon'ble Court vide order dated 11.04.2024 passed in above captioned petition report from Superintendent of Police, Panipat was sought

which has been received by way of affidavit. With regard to the arrest of accused Bijender Singh in FIR No. 449 dated 12.11.2024 under Section 420 IPC and Section 25 of BUDS Act Police 2025 Station Tehsil Camp, it is submitted that on 04.03.2025, accused Parmanand (by named accused in case FIR 449 dated 12.11.2024) was arrested in due course of law. During investigation, he confessed his role in commission of crime and got recorded his disclosure statement, disclosing that accused Bijender Singh Ruhal, Sameer Aggarwal, Shawab Hussain, Pariskhit Parse, Narender Negi, Pankaj Aggarwal, R.K Sethi, Rajesh Tagore, Sanjay Mudgil were also involved with him in the commission of crime. Thereafter, on 07.04.2025, accused Bijender Ruhal appeared in the Special Detective Unit, Panipat for joining in investigation in case FIR No. 40 dated 27.02.2025 registered at P.S Sanoli, Panipat in compliance of order dated 03.04.2025 passed by the Hon'ble High Court in CRM-M 184612025. However, there was no interim order or stay of arrest order in favour of accused Bijender Singh in any petition pertaining to case FIR 449 dated 12.11.2024 under Section 420 IPC and Section 25 of BUDS Act, 2019, as per record verified from e-courts website of Hon'ble Punjab and Haryana High Court. Hence, he was joined in the investigation of the case and was arrested in due course of law in case FIR No. 449 dated 12.11.2024 u/s 420 IPC Section 25 BUDS Act, 2019 on finding incriminating evidence against him. Further, it is submitted that the accused Bijender Singh applied for regular bail before Ld. ASJ, Panipat on 16.04.2025 which has been dismissed vide order dated 17.04.2025.”

In the light of above, the instant petition does not warrant further

interference. Hence the same is disposed off.
