At this stage, on the a s king of the Court, Mr. Subhash Godara, Addl.A.G., Punjab acc e pts notice on behalf of respondent No.1-State. Copy of the paper b ook be supplied to him during the course of day. Learned couns e l for the petitioner undertakes to secure the presence of respon d ents No.2 & 3 before the learned trial Court at the time of record i ng the statement.

In the meanwhile, the pa r ties are directed to appear before the learned trial Court/Illaqa M agistrate within two weeks from today or any other date con v enient to the trial Court/Illaqa Magistrate, to get their s tatements recorded regarding compromise and after recordi n g their statements, learned trial Court/Illaqa Magistrate is dire c ted to send report regarding the genuineness of compromise an d also to intimate whether any PO proceedings are pending again s t any of the party on or before the date fixed.

A copy of the order be sent to learned trial Court/Illaqa Magistrate through fax for com p liance.”

In c ompliance of the aforesaid or d er, a report has been received from the conc e rned jurisdictional Court that the compromise between the parties is genuine and arrived at without a n y pressure or coercion from anyone.

In v iew of the compromise and th e ratio of law laid down by the Hon’ble Supre m e Court in Narinder Singh and others vs. State of Punjab and another, (2014) 6 SCC 46 , and Shakuntala Sawhney (Mrs) Vs. Kaushalya (Mrs.) and others (1980) 1 SCC 63 and Full Bench of this Court in Kulwinder Singh Vs. State of Punjab 2007 (3) RCR (Crl.) 1052 , this petition is allowed a nd DDR No.43 dated 2 7.02.2019 under Sections 324/323/148/14 9 /325 of IPC (Annexure P-2) i n FIR No.26 dated 27.02.2019 under Sections 324/323/148/149 of IPC (Secti o n 325 of IPC added later on)
