The petitioner is seeking the concession of anticipatory bai l under Secti o n 482 of BNSS, 2023 in cas e FIR No.01, dated 01.01.2025 , under Secti o ns 420, 409 IPC, Section 13(1)(A) read with Section 13(2) o f Prevention of Corruption Act, 1988 a s amended by Prevention o f Corruption (Amendment) Act, 2018, regist e red at Police Station Vigilanc e Bureau Ra n ge Jalandhar, District Jalandhar.

On 14.01.2025, while notici n g the following submission s made by le a rned senior counsel for the pe t itioner, this Court had directe d that no coe r cive steps be taken against the petitioner:-

“Learned Senior Coun s el for the petitioner submitte d that the petitioner is a Senio r Assistant in the Improvemen t Trust. It is argued that regard i ng the same set of allegations , the Department conducted a f a ct-finding enquiry in which th e petitioner was exonerated. Thi s exoneration was subsequently

accepted by the Vigilance Bureau. However, the Learned Senior Counsel contends that inexplicably and without any plausible justification, the findings of the enquiry report have been disregarded, and the present case has been registered against the petitioner.”

Thereafter, vide order dated 10.03.2025, this Court had granted the concession of interim bail to the petitioner and asked him to join investigation.

Learned senior counsel for the petitioner submits that in compliance of order dated 10.03.2025, petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 10.03.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
