The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for issuance of direction to the respondents to consider and decide representation dated 30.01.2025 (Annexure P4) for fair and impartial investigation in FIR No.243 dated 16.12.2024 under Sections 109, 333, 3(5) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 and Section 25 of Arms Act, registered at Police Station Sadar, Jalandhar.

Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the aforementioned FIR on the basis of disclosure statement of co-accused Davinder Pal Singh who is an associate of Sanjiv Kumar @ Sanju. It is further contended that Sanjiv Kumar @ Sanju was previously arrested by police based on information regarding his involvement in smuggling as provided by the petitioner. As a result thereof, the petitioner is now being harassed by the police authorities.
