Tarun Vs State of Punjab

The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant regular bail in case FIR No.46 dated 23.03.2024 registered under Sections 307, 323, 148 & 149 of IPC, (later on added Sections 325, 353, 411, 120-B of IPC), at Police Station Anaj Mandi, District Patiala.

The FIR in the present case was registered on the basis of the statement made by HC Gurpreet Singh and the same has been reproduced below:-

“Stated that he is employed in the Punjab Police Department and is posted at Anaj Mandi Police Station, Patiala. On March 22, 2024, he, along with Constable Gurjot Singh No. 3310, & the undersigned/IO Patiala, was on patrol duty at Focal Point, Patiala, in a government vehicle+PCR vehicle No. 24. Around 8:40 PM, a call was received from the Head Constable of Anaj Mandi Police Station that a group of 40-50 youths carrying

deadly weapons were gathered near Primary School, Rasulpur Saida. Upon reaching the location, the police team attempted to stop them, but the suspects reverted with the intention of causing harm. During the incident, one of the motorcycle riders deliberately hit the police constable with vehicle No. PB-11-CK5780 (Splendor bike), causing him to fall and break his right leg & the motorcycle rider + pillions left the motorcycle there at the spot & fled. The others also fled the scene, alongwith their vehicles and weapons. The injured Senior Constable was taken to Rajindra Hospital, Patiala for treatment.”

Learned counsel for the petitioner contends that the allegations leveled by the complainant were apparently unbelievable. It has been alleged that the complainant side was attacked by 40-50 individuals, who were roaming in the area with the weapons. However, it has been alleged that the petitioner and another accused had caused injuries to police official, resulting in a fracture to his right leg. The injured has been discharged long ago. The petitioner was arrested in the present case on 06.04.2024 and is in custody since then.

On the other hand, status report by way of an affidavit of Deputy Superintendent of Police, City-II, Patiala has been filed by learned State counsel in Court today and the same is taken on record. Learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that serious allegations have been levelled against the present petitioner and he does not deserve the concession of bail by this Court. 5. I have heard the learned counsel for the parties and perused the record.

In the present case, the injured has already been discharged from the hospital. Even the challan has been presented against the petitioner and out of total 23 witnesses, no witness has been examined so far. Thus, the conclusion of the trial may take quite a long time and further custody of the petitioner will not serve any meaningful purpose.

Without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate, concerned.
