Second petition under Section 482 Cr.P.C. filed by Divyansh Verma seeking quashing of FIR No.0117 dated 22.05.2024 under Sections 279/337/338 of IPC registered at Police Station Radaur, District Yamuna Nagar, and all subsequent proceedings arising therefrom, on the basis of a compromise dated 28.05.2024 between the parties. An earlier quashing petition had been withdrawn on 11.02.2025 with liberty to file afresh after impleading all accused and stakeholders. By order dated 06.03.2025 the parties were directed to appear before the trial Court/Illaqa Magistrate for recording their statements regarding the compromise, and the trial Court was asked to report on its genuineness and on any pending PO proceedings; the jurisdictional Court reported the compromise genuine and arrived at without pressure or coercion. Relying on Narinder Singh and others v. State of Punjab and another, (2014) 6 SCC 466, Shakuntala Sawhney (Mrs) v. Kaushalya (Mrs.) and others, (1980) 1 SCC 63, and the Full Bench of the Punjab & Haryana High Court in Kulwinder Singh v. State of Punjab, 2007 (3) RCR (Crl.) 1052, the High Court allowed the petition and quashed the FIR and all subsequent proceedings arising out of it, qua the petitioner.

This is the second petition that has been filed under Section 482 Cr.P.C. seeking quashing of FIR No.0117 dated 22.05.2024 under Sections 279/337/338 of IPC registered at Police Station Radaur, District Yamuna Nagar (Annexure P-1) along with all subsequent proceedings arising therefrom on the basis of compromise dated 28.05.2024 (Annexure P-2).

The first petition seeking quashing of FIR (supra) was withdrawn on 11.02.2025 with liberty to file a fresh petition, after impleading all the accused and stakeholders.

At this stage, on the asking of the Court, Ms. Geeta Sharma, DAG, Haryana accepts notice on behalf of respondent No.1-State and Mr. Vikas Bairagi, Advocate accepts notice for respondent Nos.2 to 4 and files his power of attorney, which is taken on record. He admits to the factum of compromise. Copy of the paper book be supplied to them during the course of day. Service is complete.

In the meanwhile, the parties are directed to appear before the learned trial Court/Illaqa Magistrate within two weeks from today or any other date convenient to the trial Court/Illaqa Magistrate, to get recorded their statements regarding compromise and after recording their statements, learned trial Court/Illaqa Magistrate is directed to send report regarding the genuineness of compromise and also to intimate whether any PO proceedings are pending against any of the party on or before the date fixed.

A copy of the order be sent to learned trial Court/Illaqa Magistrate through fax for compliance.”

In compliance of the aforesaid order, a report has been received from the concerned jurisdictional Court that the compromise between the parties is genuine and arrived at without any pressure or coercion from anyone.
