Present civil revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 05.05.2025 (Annexure P-13) passed by the Civil Judge (Junior Division), Patti, District Tarn Taran, whereby application under Order 6 Rule 17 read with Section 151 CPC for amendment of the plaint has been dismissed.

Learned counsel for the petitioners has submitted that the suit in the present case was filed for declaration on 16.09.2016 and during the pendency of the said suit, an order dated 06.02.2019 had been passed in the mutation proceedings in favour of present respondents No.6 to 11

with respect to the suit property and it is the averment regarding the said mutation that the petitioners wish to add. It is further submitted that since it is a matter of settled law that the mutation proceedings are not binding on the Civil Court, more so, when the said mutation has been passed during the pendency of the suit, thus, the petitioners be permitted to withdraw the present revision petition with liberty to raise all pleas, which have been raised in the present petition and are available to them in law, during the course of arguments.

Dismissed as withdrawn, with the aforesaid liberty.
