CM-17922-CII-2025 has been filed under Order 23 Rule 3 CPC for disposal of the revision petition i.e. CR-389-2008, on the basis of the compromise deed dated 30.08.2025.

The revision petition has been filed by the tenant to assail the order dated 23.10.2007, whereby an application for leave to defend, was dismissed. However, during the pendency of the revision, compromise has been effected between the parties, copy whereof is Annexure C-1. On the basis of the recitals of the said compromise, counsel for the applicant/petitioner submits that the vacant possession of the tenanted premises, has since been handed over to the respondent on 10.09.2025.

Even, counsel for the respondent, who is making appearance through video conferencing, do not dispute about the genuineness of the said
