The Ramgarh Sardaran Cooperative Society and Another Vs Ramesh Kumar Singla and Others

This is a civil revision petition under Article 227 of the Constitution of India for setting aside the impugned order dated 16.10.2020 (Annexure P-10) passed by the Additional District Judge, Ludhiana, vide which application under Order 39 Rules 1 and 2 CPC filed by the petitioners had been dismissed.

On 22.01.2021, a coordinate Bench of this Court was pleased to pass the following order:

Learned counsel for the petitioners inter alia argues that the appellate Court has found that the petitioners were in possession of two rooms and office as a tenant. Thus, it could not have allowed the appeal in toto. The petitioners

were atleast entitled to partial injunction in respect of the property admittedly in its possession.

Meanwhile, the respondents are restrained from interfering in the tenanted premises of the petitioners.

It is not in dispute that the said order is continuing till date. It has been brought to the notice of this Court that the suit which was filed in the year 2018 has now reached the stage of defendant evidence. During the course of arguments, it has been jointly submitted that the trial Court be requested to decide the suit as expeditiously as possible and the interim order dated 22.01.2021 be continued till the time the suit is decided. It is further submitted that the trial Court be requested to decide the case independently on the basis of the evidence and documents on record, uninfluenced by the observations made in the order dated 22.01.2021.

Keeping in view the abovesaid facts and circumstances and the fair stand taken by learned counsel for the petitioner and learned counsel for the respondents, the present revision petition is disposed of with the following observations/directions:

(i) The trial Court is requested to decide the suit which has been pending since 2018 as expeditiously as possible. All the parties

concerned would fully assist the trial Court in the expeditious disposal of the case.

(ii) The interim order dated 22.01.2021 would continue till the time the suit is decided. The grant and continuation of the said interim order would not be construed as an expression on the merits of the case and the trial Court would decide the case independently on the basis of the documents, pleadings of the parties and evidence on the record, after hearing all the parties
