The present contempt petition has been filed for deliberate and intentional disobedience of order dated 11.04.2023 passed by this Court in CWP-4807-2022 which has been decided in terms of decision rendered in CWP-4455-2022, whereby, respondents were directed to reconsider the claim of the petitioners for promotion to the rank of Deputy Superintendent of Police from the date person at par with them/junior to them have been promoted, expeditiously within a period of four weeks from the date of receipt of certified copy of the order.

The relevant portion of compliance affidavit of Gurkirat Kirpal Singh, IAS, Administrative Secretary, to Government of Punjab, Department of Home Affairs & Justice (being Respondent No.1) dated 12.04.2024, is reproduced as under:-

That it is submitted that a meeting of the Departmental Promotion Committee was held on 25.10.2023 by the office of answering respondent in order to determine the eligibility of deemed date promotion to the rank of DSP given on 30.07.2021 (Annexure P-6) as per the condition (I) in the previous deemed date order dated 30.07.2021 mentioned in para No.8 above regarding considering the names of eligible officers in the DPC meeting, the office of answering respondent conducted DPC meeting on 25.10.2023 to consider the names of the eligible officers for grant of deemed date of promotion as DSP and passed speaking order bearing No. Home-HM-30 ESBM/85/2023-H3/1/747276/2023 dated 21.12.2023 (Annexure-R-1)

11. That it is submitted that the petitioner Retd. Inspector Sukhram Singh No. 732/RP, 1009/PR (Retired) was granted "F" list as 28.04.1999 in the revised seniority and he was eligible for promotion to the rank of DSP 28.04.2005 after completion of six years mandatory service in the rank of Inspector as per rule 6(1)(A) of Punjab Police Services Rule 1959. He retired from service on 31.07.2009. The petitioner has been granted deemed date promotion to the rank of DSP as 31.10.2007 vide State Govt. order No. Home-HM-30 ESBM/85/2023H3/1/747276/2023 dated 21.12.2023 (Annexure R-1).”
