The present contempt petition has been filed for deliberate and intentional disobedience of order dated 27.03.2017 passed by learned Civil Judge (Jr. Divn.), Ludhiana in Civil Suit No. 3749/2014, whereby the Court has specifically ordered that the parties shall remain bound by their statements and compromise. The statements of the parties were recorded on 27.03.2017.

On the last date of hearing i.e 08.08.2025, the respondent was directed to bring amount of Rs.30,000/- to be paid to the petitioner today. Today, the son of the respondent (who is present in the Court) brought cash of Rs.15,000/- only.

Learned counsel for the petitioner contends that the above civil suit was filed in the year 2014 for specific performance of agreement to sell dated 28.05.2013 for sale of House bearing No. 50-A, measuring 147 Sq yards. The civil suit was withdrawn on 27.03.2017 on the basis of compromise dated 04.01.2017 effected between the parties. He further submits that the present contempt petition

Learned counsel for the respondent submits that the respondent has paid a sum of Rs. 1,80,000/- to the petitioner during the pendency of the present contempt petition. Learned counsel for the petitioner does not dispute the same.

A perusal of the contempt petition and order passed in the contempt petition shows that the respondent is not complying with the compromise dated 04.01.2017 effected between the parties despite the fact that there is agreement to sell and the petitioner has paid a sum of Rs.5,00,000/- as earnest money to the respondent. The respondent is not ready and willing to return the money or to perform her part, for selling the house in question, as per agreement to sell dated 28.05.2013.

In view of the above, learned counsel for the petitioner wishes to withdraw the present contempt petition with a liberty to revive Civil Suit No. 3749/2014.

Accordingly, the present petition is dismissed as withdrawn with a liberty to the petitioner to file an application for revival of Civil Suit No. 3749/2014.
