Vs. State of Punjab & others.'). The contempt petition has been filed for deliberate and intentional disobedience of order dated 23.03.2023 passed in CWP-68472020, which is reproduced as under:-

“ The present petition has been filed seeking issuance of directions to the respondents to release the investment incentive as per (Annexure P-1) dated 07.05.2001.

Reply by way of affidavit of Manavpreet Singh, General Manager, District Industries Centre, Amritsar on behalf of the respondents has been filed today in Court. Copy thereof has been furnished to learned counsel for the petitioner.

Learned counsel for the petitioner, however, contends that at this juncture, he would be satisfied in case the present petition is disposed of in term of the order dated 02.04.2019 passed in CWP-8898 of 2019

Learned State Counsel has no objection to the petition being disposed of in terms of the aforesaid order. Hence, in view of the above and without commenting on the merits of the case, the present petition is disposed of in terms of the above mentioned order dated 02.04.2019. ”

Learned State counsel contends that in compliance of order dated 23.03.2023, affidavit of Mr. Inderjit Singh Tandi, General Manager, District Industries Centre, Amritsar dated 14.02.2024 along with speaking order dated 19.09.2023 (Annexure R-1), has already been filed.

The relevant paras of affidavit dated 14.02.2024 are reproduced

“5. That this Hon’ble Court in CWP No.19007 of 2002 titled as “Balak Gases Vs. State of Punjab and others” and other connected matters, this Hon’ble Court in para 46 of the judgment dated 20.05.2011 held that the incentives/subsidies and other benefits be released to the petitioner industries if they are otherwise eligible and entitled to it. It is stated that as explained in para 4 above the petitioner, is not eligible for release of capital subsidy as per guidelines of the Govt. issued vide notification dated 13.11.2019. The claim case of the petitioner for release of sanctioned capital subsidy was considered in detail in compliance of the order dated 23.03.2023 (Annexure P-1) passed by this Hon'ble Court in the light of Govt. guidelines issued on 13.11.2019 and the petitioner was not found eligible for release of capital subsidy and a detailed speaking order was passed on

6. That the order dated 23.03.2023 (Annexure P-1) has been fully complied with vide detailed speaking order considering the entire facts on record and affording opportunity of hearing to the petitioner, was passed on 19.09.2023.

7. That it is respectfully submitted that in compliance of the order dated 23.03.2023 the competent authority i.e. the Director of Industries and Commerce Punjab has passed the detailed order dated 19.09.2023 (Annexure R-1).

8. That the petitioner is not eligible for release of capital subsidy as per the Guidelines dated 13.03.2019 and its claim has been rightly rejected vide order dated 19.09.2023 (Annexure R-1) after considering the entire facts on record in detail.”

A perusal of affidavit dated 14.02.2024, shows that order dated 23.03.2023 passed in CWP-6847-2020, has been complied with. This fact is not disputed by learned counsel for the petitioner.
