Contempt petition alleging deliberate and intentional disobedience of the order dated 29.08.2018 passed in CRM-M-18023-2018, whereby FIR No.78 dated 26.11.2013 registered under Sections 498-A, 494 & 120-B IPC at Police Station Women, District Bathinda, and all consequent proceedings, were quashed on the basis of compromise between the parties, following the Full Bench principles in Kulwinder Singh (2007(3) RCR (Criminal) 1052) as approved in Gian Singh ((2012) 10 SCC 303). By application CM-19460-CII-2025 under Section 151 CPC, the affidavit of respondent No.3-Gurcharan Kaur @ Charanjit Kaur with Annexure R-2 was taken on record; the affidavit averred that she had been in possession of the house at village Jodhpur Romana for 37/38 years, had effected transfer only by registered Will dated 12.12.2019 in favour of her grandsons, had complied with condition (vii) of the Settlement Agreement (P-1) and the order (P-2), and had made no alteration/addition to or transfer of the property. This is an application filed under Section 151 of the Code of Civil Procedure, 1908, for placing on record short reply by way of affidavit of respondent No.3-Gurcharan Kaur @ Charanjit Kaur along with Annexure R-2.

For the reasons mentioned in the application which is supported by an affidavit, the same is allowed.

“The instant petition is for quashing of FIR No.78 dated 26.11.2013 registered under Sections 498-A. 494 & 120-B of IPC at Police Station Women, District Bathinda and the consequent proceedings arising out of the same, on the basis of compromise arrived at between the parties.

Report has been received from the trial Court after statements of the parties were recorded regarding the compromise. The trial Court has reported that the compromise is voluntary, in their full senses and without any kind of pressure. The trial Court has also ent copies of statements of the parties.

Learned counsel for the State on instructions submits that petitioners are the only accused and respondent no.2 is the only aggrieved person in this FIR.

No useful purpose would be served to keep the FIR pending.

In view of the statements and report of the trial Court and the principles laid down by the Full Bench judgment of this Court in Kulwinder Singh and others Vs. State of Punjab and another, 2007(3) RCR (Criminal) 1052 , approved by Hon'ble Apex Court in Gian Singh Vs. State of Punjab and others (2012) 10 SCC 303 , the instant petition is allowed and the aforesaid FIR and all consequent proceedings conducted on the basis thereof are quashed.

Needless to say that parties shall remain bound by the terms of compromise and their statements made in the Court below.”

Learned counsel for respondents No.1 to 3, 5 & 6 contends that in compliance of order dated 29.08.2018, affidavit of respondent No.3Gurcharan Kaur @ Charanjit Kaur dated 18.09.2025, has been filed.

The relevant paras of affidavit of Ms. Gurcharan Kaur @

Charanjit Kaur, are reproduced as under:-

“1. That in order to clarify the facts, the answering respondent No.3/deponent approached to the Sarpanch of village Gram Panchayat Jodhpur Romana, District Bathinda to verify the facts regarding the existing position of the house in question at village Jodhpur Romana, District The Bathinda. consisting of Gram Panchayat Sarpanch after duly verified, issued a certified date 01.08.2023 (Annexure R-2), whereby it has categorically stated that the answering respondent no.3/ deponent having possession of house for the last 37/38 years and the same area and house is/was to be transferred by way of registered Will in favour of her grandsons on 12th December, 2019. There is other no house/ residential property in occupation of answering respondent no.3/ deponent at village Jodhpur Romana, District Bathinda. Nor the answering respondent no.3/ deponent has ever transferred any portion of any property situated at village Jodhpur Romana, District Bathinda. It is relevant to mention here that the answering respondent no.3/deponent is illiterate and old lady aged about 70 years from the village folk and also suffering from different ailments.

That the answering respondent no.3/deponent the has already complied condition no.vii of the Settlement Agreement (P-1) as well as order (P-2), hence the answering respondent no.3/ deponent has not violated the order passed by this Hon'ble High Court. The answering respondent no.3/deponent has already executed the registered Will Annexure R-1 with appended CM No.9925-CII of 2022) in favour of her grandsons namely Pinkjeet Singh and Arshjeet.

3. That the answering respondent no.3/ deponent has not made any type of or transferred alteration/ addition any part/ portion of house mentioned in her registered Will in favour of her grandsons namely Arshdeep Singh and Pinkjeet Singh.”
