The present contempt petition has been filed for deliberate and intentional disobedience of order dated 04.05.2023 passed by this Court in CWP5702-2023.

The operative part of order dated 04.05.2023 passed by this Court in CWP-5702-2023 is reproduced as under:-:-

“2. State counsel has placed on record a copy of communication dated 03.05.2023 received from the Director, Development and Panchayat Department, Haryana, relevant extract of which is as under:-

"It is submitted that instructions have been issued to Executive Engineer Panchayati Raj, Sonipat for making entry of higher qualification i.e AMICE(I) in the Service Book of the petitioner vide this office letter No 46095 dated 25.4.2023 (Copy enclosed). It is further submitted

asked vide this office letter No.46900 dated 27.4.2023 (Copy enclosed) to send the record of the petitioner so that his case for promotion could be considered. The Hon'ble High court may kindly be apprised of the above position. The case is listed for hearing on 4.5.2023"

3. In view of the above, prayer made in the petition has become infructuous.”

In compliance of the above order, compliance report by way of affidavit dated 09.07.2024 of Sh. Amit Kumar Agrawal, Commissioner and Secretary, Development and Panchayats Department Haryana, Chandigarh has been filed on behalf of the respondent. The relevant portion of the same reads as under:-

“3. That a bare perusal of the ibid orders of this Hon'ble High Court reveals that there were no specific directions to comply with and as such the leveled allegation of noncompliance of orders in question dated 04.05.2023 against the Department of deponent, is unfounded. In fact, the petitioner had filed CWP No. 5702 of 2023 against the department for not adding his degree of AMICE in the service book and not sending his case for promotion to the post of Sub-Divisional Engineer. When this matter came up before this Hon'ble Court on 04.05.2023, the department of deponent by way of communication dated 03.05.2023 apprised that the Executive Engineer Panchayati Raj, Sonepat has been asked to enter his degree in the service book and the Superintending Panchayati Raj Rohtak has also been asked to send his record, so that his case for promotion could he considered. days retired from the service on 31.05.2023. An order to the effect of his retirement was issued and communicated to him. Copy Annexed here with as Annexure R-1. Seeking of record is a preliminary process of promotion. Subsequently, Departmental Promotional Committee meeting is convened to adjudge to suitability of Junior Engineers for promotion to the post of Sub-Divisional Engineer against all the existing vacancies and anticipated vacancies to be available in a Calendar Year and not that of any individual. In some cases, validity of degree is also got ascertained from the Director Technical Education, 17 such exercise of convening of meeting of Departmental Promotion Haryana. Thereafter any proposal of promotion is finalized. Last year of 2023 Committee was carried out on 23.06.2023 and 13.07.2023 respectively and promotion orders finalized on 14.08.2023. Thus, the petitioner before becoming part of this process of promotion, which concluded in the month of July-August, 2023, already retired from the service on 31.05.2023. It is submitted that no Junior Engineer to the petitioner (seniority No. 397) was promoted to the post of Sub Divisional Engineer (Civil) upto 31.05.2023 i.e. his retirement. Moreover, senior Junior Engineers namely i.e. S/Sh. Anil Kumar (seniority No. 295), Anil Kumar Singla (seniority No. 327), Sabir Yasin (seniority No. 352), Prithvi Raj (seniority No. 375), Habib Ahmad (seniority No. 376), Mohd. Aslam (seniority No. 388) were promoted as Sub Divisional Engineer (Civil) w.e.f. 14.08.2023. Hence, the

petitioner has no legitimate right to get promotion as Sub Divisional Engineer (Civil) before 14.08.2023 whereas he has been retired from Govt. service w.e.f. 31.05.2023”

In view of the above, order dated 04.05.2023 passed by this Court in CWP-5702-2023 has already been complied with. This fact is not disputed by learned counsel for the petitioner. A copy of the reply dated 09.07.2024 has also been supplied to learned counsel for the petitioner in the Court today.
