Present contempt petition has b een filed alleging violation of order dat e d 27.3.2018 (Annexure P-1) pas s ed by a co-ordinate Bench of this Cour t in CWP-22845-2016 titled as “ S hami Kumar vs. Punjab State Power Co r poration Ltd. and others”, which w as also disposed of in terms of judgment of even date passed by the sam e co-ordinate Bench in CWP17100-20 1 6 in case titled as “Paramjit S ingh vs. Punjab State Power Corporati o n Ltd. and others” vide which t h e petition was disposed of in terms of t h e ratio of law laid down by this C o urt in CWP-20139-2015 titled as “Chim a n Singh vs. Punjab State Power C o rporation and others”, decided on 29.2.2 0 16 and the respondents were dire c ted to treat the petitioner(s) at par with t h e petitioner(s) in Chiman Singh’s case and consider the claim of the petiti o ner(s) in the light of the said c a se and pass the consequential

order wit h in a period of three months from t he date of receipt of a certified copy of this order.

On the last date of hearing i.e. 10.09.2025 there was no represent a tion on behalf of petitioner. Toda y also there is no representation on behalf of petitioner. As such, the ma t ter is being disposed of after perusing t h e case file and hearing learned co u nsel for the respondents.

Learned counsel for the respondent No.1 informs this Court that first a nd foremost the present contempt petition is barred by limitation as petitio n er has approached this Court afte r seven years of passing of the Writ Cou r t order dated 27.3.2018. It is sub m itted that accordingly in terms of Sectio n 20 of the Contempt of Courts Ac t , the present contempt petition is not mai n tainable.

It is further submitted that in any event, the order dated 27.3.2018 stands complied with as the resp o ndents have passed a Speaking Order dat e d 27.6.2025 (Annexure R-2), w h ich is annexed with the reply dated 03. 7 .2025/11.7.2025 filed on behalf o f respondent No.1 by way of affidavit of Mr. Ajoy Kumar Sinha, I A S, Chairman-cum-Managing Director, Punjab State Transmission C o rporation Ltd., whereby the petitioner has already been promoted as Lineman. Learned counsel particular refers to the submissions made i n para 6 of the said reply dated 03.7.2025 / 11.7.2025, which reads as follows :-

6. That the petiti o ner's claim was considered keeping in view the fac t that the judgment rendered in present case was decid e d in terms of the law laid down in C.W.P. No.20139 of 2 015, Chiman Singh Vs PSPCL and others, thereafter it was found that the benefit of 23 years advance pro m otional increment is liable to be granted to the petiti o ner, however, it was found that

keeping in view vario u s instructions as well as the factum he stood promo t ed as Lineman and his fixation of revised pay would e ventually lead to no financial benefits. Copies of the O ffice Order dated 25.06.2025 issued in pursuance to th e directions Shami Kumar (P1) as well as speaking Order dated 27.06.2025 have been passed consideri n g petitioner's case as well as the comparative pay fi x ation sheet passed in view of the directions issued b y Hon'ble Court and the said speaking Orders are annexed are Annexures R-1 to R- 3 respectively.
