Petitioner has approached this Court praying for directing the Sub Divisional Magistrate-cum-Assistant Collector, Garhshankar, to keep the execution proceedings (Annexure P-7) in abeyance until learned District Collector, Hoshiarpur hears the appeal. It is further prayed to issue direction to learned District Collector, Hoshiarpur, to decide the appeal including the stay application in a time bound manner.
Learned counsel for the petitioner fairly submits that the appellate Court has granted stay and thus, the present petition has become infructuous and may be disposed of as such.
In view of the prayer made by learned counsel for the petitioner, the present petition is disposed of as having been rendered infructuous.
