This petition seeks quashment of impugned order dated 13.09.2024 (Annexure P-19) by which the conditional permission for admitting students by the petitioner-college has been denied by respondent No.3- President, medical Assessment and Rating Board for Indian System of Medicine (NCISM) after finding deficiencies in the pre-requisites to be satisfied by petitioner-college as per Indian Medicine Central Council (Requirements of Minimum Standard for under-graduate Ayurveda Colleges and attached Hospitals) Regulations, 2016.

It is not denied by learned senior counsel for the petitionercollege that two appeals dated 22.08.2024 and 21.09.2024 under Section 24(3) of the National Commission for Indian System of Medicine Act, 2020 against the aforesaid impugned order are pending before respondent No.2-National Commission for Indian System of Medicine which have not yet been decided

Since the disputed questions of facts have been raised as regards the availability and non-availability of faculty as per the requirement of the aforesaid regulation, this Court deems it appropriate not to enter merits and leave it for the Appellate Authority to deal with the issue expeditiously.

Consequently, without commenting upon the merits of the case, this petition stands disposed of with direction to respondent No.2-National Commission for Indian System of Medicine to decide the aforesaid appeals of the petitioner-college by 07.10.2024 by passing a speaking order.
