The pet i tioner seeks grant of anticipatory bail in respect o f aforemen t ioned FIR.

“At the very outset learned co u nsel for the petitioner submits tha t the matter in fact arises out of non-payment of some installments o n account of the loan which the petition e r had raised.

Learned counsel for the petiti o ner submits that it was on accoun t of s etting in of Covid that the petitio n er could not repay the amount du e to f inancial crunch. Learned counse l has however, submitted that th e pet i tioner is willing to settle the ma t ter amicably for some reasonabl e ter m and in order to prove his bonaf i des he shall deposit an amount o f Rs. 3 lakhs with the respondent-Ban k /complainant within a period of 2 we e ks from today.

The petitioner as well as the c omplainant are directed to appea r be fo re Mediation and Conciliation Ce n tre of this Court on 12.2.2024.

Meanwhile, in the event of a r rest, the petitioner be released o n int e rim bail subject to his furnishing p ersonal bonds and surety bonds t o the satisfaction of Arresting/Inve s tigating Officer. However, th e pet i tioner shall join the investigation as and when called upon to do s o an d cooperate with the Arresting/In v estigating Officer and shall abid e by t he conditions as provided under S e ction 438 (2) Cr.P.C.”

Pursuant t o the aforesaid order, the partie s appeared before the Mediatio n & Conci l iation Centre of this Court, wherein the matter has bee n amicably resolved and a schedule has be e n prepared for repayment of th e loan amo u nt.

Learned c ounsel representing responden t No.2 has endorsed the factu m of compr o mise and submitted that he w o uld not have any objection fo r grant of a nticipatory bail to the petitioner. 5. Having r e gard to the aforestated positio n , wherein the matter is stated t o be amica b ly resolved, the petition is acc e pted and the interim direction s issued b y this Court vide order date d 05.02.2024 are hereby mad e absolute subject to the condition t h at the petitioner shall joi n investiga t ion as and when called upon t o do so and cooperate with th e Investiga t ing Officer and shall also abid e by the conditions as provide d under Se c tion 438 (2) Cr.P.C.
