Prayer in this petition is for grant of anticipatory bail to the petitioners in case FIR No.0002 dated 02.01.2024 under Sections 452/323/148/149/506/427 of the IPC registered at Police Station Sadar Abohar, District Fazilka.

Mr. Narender Singh Kamboj, Advocate, has entered appearance on behalf of the complainant and filed memorandum of appearance, which is taken on record.

While issuing notice of motion on 22.01.2024, following submissions of learned counsel for the petitioners were recorded:-

“Learned counsel for the petitioners inter alia contends that all the offences except for Section 452 which have been added in the FIR are bailable. It has been further submitted that even a perusal of the allegations levelled in the FIR in question reveals that no specific role much less any injury has been attributed to the petitioners in the occurrence in question. ”

On the last date of hearing, learned State counsel, on instructions, had informed the Court that the petitioners are not involved in any other criminal case, much less a case of similar nature. Hence, the petitioners had been granted interim anticipatory bail with direction to join investigation.

Learned counsel for the petitioners submits that in compliance of order dated 18.03.2024, the petitioners have joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Kuldeep Singh, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He on further instructions submits that the petitioners are not required for further investigation much less for their custodial interrogation.

In view of the above, the petition is allowed and interim order dated 18.03.2024 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
