[6] Initially, the petitioner approached this Court, seeking pre-ar r est bail, the same was dismissed. Learn e d Apex Court vide order d a ted 22.09.20 2 3 granted interim bail to th e petitioner, which was later on dismisse d vide order dated 10.01.2024 o n the statement made by lear n ed State Co u nsel that after the interim ba i l was granted, the petitioner w as abscondi n g and was not co-operating in t h e investigation. [7] Counsel for the petitioner s u bmits that the non-joining of the investiga t ion by the petitioner was owi n g to mis-communication between him and h is counsel. His counsel infor m ed him that there was no orde r to join the i n vestigation. Counsel for the p e titioner submits that the petiti o ner is behin d bars for more than 09 mont h s and 21 days. Apart from b ald allegatio n s that the petitioner absconde d , there is no other incrimina t ing evidence against the petitioner. He sub m its that even as per the case of the prosecuti o n, on receiving secret informat i on, the road was barricaded.
