1 . Challenge is by the plaintiff-appellant to the findings of fact recorded by both Courts below in a suit filed by plaintiff-appellant for declaration.
2 . Learned counsel for the appellant on instructions from Ram Kumar s/o Hari Singh submits that the matter has since been settled between the parties and no dispute survives. He prays for withdrawal of the instant appeal.
3 . In view of the aforesaid statement, the present appeal is hereby dismissed as withdrawn with liberty to get it revived, in case, any cause of action still survives.
