Learned counsel for the petitioner submits that the petitioner, who is the mother of the deceased/employee namely Dr. Jagdeep Aggarwal, is entitled for the grant of family pension and other service benefits, hence, the respondents No. 1 to 3 are liable to be directed to grant the same to the petitioner. Further, the claim of the petitioner is for the grant of compassionate financial assistance under Haryana Civil Service (compassionate financial assistance of appointment) rules, 2019 as applicable to the dependents of the deceased-employee.

Learned counsel for the petitioner submits that the grievance raised in the present petition has already been raised in the representation attached as Annexures P-10 to P-12 which are still pending consideration and the petitioner will be satisfied in case the same are decided by passing appropriate speaking order.

Mr. Gurinder Pal Singh, Advocate appears on behalf of respondents No. 4 and 5 and submits that he has no objection in case the Government decides the representation filed by the petitioner. He further submits that private respondents be also allowed to file an appropriate representation raising their own claim qua the services benefits of the deceased-employee and the said representation be also kept in mind while deciding the representation filed by the petitioner.

Learned State counsel submits that any representation filed by the petitioner, which is still pending before the authorities concerned including the representation attached as Annexures P-10 to P-12 as well as any representation filed by the private respondents will be decided within a period of 8 weeks from the date of receipt of the copy of the present order and while passing the said speaking order, the representation filed by the private respondents shall also be kept in mind.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further.
