This contempt petition is pending since 2018 and is filed for non-compliance of the order dated 15.11.2017 vide which it was directed that the petitioner will hand over the physical possession of the property mortgaged with the bank within 10 days.
Counsel for the respondents M/s. Shiv Shankar Rice Mills has placed on record an order dated 28.02.2023 passed in CWP No.6872 of 2019, to submit that some one time settlement is arrived at between the petitioner/Bank and the respondents and the time is granted till 31.03.2023 for making the compliance of OTS.
In view of the above, the present petition is disposed of having been rendered infructuous.
However, liberty is granted to the petitioner to avail the alternative remedy in accordance with law, if so advised.
