Prayer in this writ petition is for setting aside order dated 09.08.2021(Annexure P-7) passed by Deputy Commissioner, Panipat(respondent No.3) on the ground that plots measuring 100 square yards have been illegally allotted to ineligible persons in contravention of the policy dated 01.02.2008 (Annexure P-1).
Learned counsel for the petitioner, while referring to the written statement filed on behalf of respondents No. 3 to 5, submits that though revised order dated 12.08.2022 has been passed by the Deputy Commissioner, Panipat cancelling allotment of plots to some of the beneficiaries, however, allotment of some of the ineligible allottees has still not been cancelled.
In view of passing of revised order dated 12.08.2022 (Annexure R-1) by the Deputy Commissioner, Panipat, learned counsel for the petitioner seeks to withdraw this writ petition with liberty to challenge the said order in accordance with law.
Dismissed as withdrawn with liberty as aforementioned.
