Petitioner herein inter alia seeks issuance of a writ in the nature of mandamus directing the respondent-commission to award himadditional 5 marks for thepost of Veterinary Livestock Development Assistant (VLDA) towards socio economic criteria on the basis his orphan certificates contained at Annexures P-4 to P-12.

Learned counsel for the petitionerrelies on clause 2.3 (iii) (b) (ii) & (iii) of advertisement No.15/2019 dated 07.09.2019-category No.11 (Annexure P-1). He submits that petitioner’s father died before he attained the age of 15 years and he is second child of his parents and therefore entitled to additional 5 marks.

Learned counsel also relies on a judgment/order passed by this Court in CWP No.11894-2021 decided on 30.07.2021 titled as Nisha Vs. Haryana Staff Selection Commission contained at Annexure P-16.

On advance service, learned State counsel appears and strenuously opposes issuance of notice of motion. She submits that writ petition is pre-mature as the final result is yet to be declared. However, she

submits that competent authority shall take decision either way, in due course, by treating the instant petition as representation.

Learned counsel for the petitioner also agrees that let a final decision be taken, by the competent authority by treating the writ petition as a representation.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the competent authority to look into the grievance of the petitioner and also by keeping in view the contentions raised in the present petition by treating the same as representation and take a decision, by keeping in mind the judgment dated 30.07.2021 passed in CWP No.11894-2021 (Annexure P-16), in accordance with law, as expeditiously as possible.
