The Court has been convened through video conferencing due to Covid-19 pandemic.
Instant writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus.
In pursuance to order dated 16.12.2019 passed by this Court, an affidavit of District Magistrate, Rupnagar has been filed, wherein, it has been stated as under:-
“2. That in compliance with these orders of Hon'ble High Court, deponent directed the Sub Divisional Magistrate, Sri Chamkaur Sahib to look into the matter and submit the detailed report. The Sub Divisional Magistrate, Sri Chamkaur

Sahib vide memo no.11/Peshi Dated 01.01.2020 (Annexure R- 1) comprised a team of Tehsildar, Sri Chamkaur Sahib, DSP Sri Chamkaur Sahib, Labour Enforcement Officer, Rupnagar was constituted and was directed to visit the spot and submit the report. This team visited the said Brick Kiln Marka A+S, resident of village Basigurja, Tehsil Chamkaur Sahib, District Ropar on 31.12.2019. At the time of visit of this team only 2 labourers were present on this brick kiln. The labourer namely Banno wife of Mahmod and mentioned in the criminal writ petition No.2198 of 2019 were not found present on the concerned brick kiln. The statement of labourers present at the time of the visit of the team was recorded. In their common statement, they stated that the labourers mentioned in this criminal writ petition namely Banno wife of Mahmod and others not working on this Brick Kiln and never came for work.”
In view of the situation depicted in the above affidavit, no
orders are called for.
Petition is dismissed.
