This is a petition that has been filed for grant of regular bail in case FIR No.61 dated 16.05.2017 under Sections 379-B, 34 IPC registered at Police Station Sujanpur, District Pathankot.
Learned counsel for the petitioner would contend that the petitioner herein has been falsely implicated in the said FIR as initially the FIR was registered against three unknown persons. The investigation is complete and the challan stands presented. The petitioner is in custody since 17.05.2017. No recovery is to be effected from the petitioner and therefore, custodial interrogation of the petitioner would no longer be required.
Learned counsel appearing for the respondent-State opposes grant of bail to the petitioner by contending that no ground for grant of bail to the petitioner is made out.
I have heard learned counsel for the parties. Keeping in view the fact that the investigation is complete and the challan stands presented

and the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
