The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 269, dated 24.12.2019, under Section 306 IPC, registered at Police Station Tanda, District Hoshiarpur, Punjab.

Learned counsel for the petitioner contends that the petitioner, who is the husband of the deceased, has been falsely implicated in the case in hand, which finds credence from FIR in question, inasmuch as, all the allegations qua abetment to suicide, have been levelled against the coaccused Sahil. Learned counsel for the petitioner further submits that the petitioner has been in custody since 05.10.2020 and the trial is unlikely to conclude in the near future. He further submits that only 02 out of the 15 prosecution witnesses cited have been examined so far, which also include the complainant, who did not support the case of the prosecution and was

declared hostile.

Per contra , learned State counsel while opposing the prayer and submissions of learned counsel for the petitioner, on instructions from ASI Paramjit Singh, has conceded that the complainant did not support the case of the prosecution and was declared hostile.

In view of the submissions made by learned counsel for the parties, I deem it a fit case for grant of the concession of regular bail to the petitioner, as the trial is unlikely to conclude in the near future, more so, in the prevailing conditions due to the outbreak of COVID-19. The petition as such is allowed and the petitioner is admitted to bail to the satisfaction of trial Court/Duty Magistrate. However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
