Learned counsel for the applicant/appellant submits that the original appellant-Harbhajan Singh has since passed away and applicant-Amarbir Singh is the only legal heir of appellant – Harbhajan Singh. It is submitted that no dispute is pending regarding the estate of Harbhajan Singh and the applicant no longer wishes to continue with this appeal. It is further submitted that a copy of this application has been duly conveyed to the respondent through courier.

At request of learned counsel for the applicant/appellant, the appeal is taken up for hearing today itself.

Keeping in view the stand of the applicant as above and his categoric assertion, application is allowed and appeal is accordingly dismissed as withdrawn.
