Present petition under Section 482 Cr.P.C. for setting aside the summoning order dated 23.05.2018 (Annexure P2) and for quashing of complaint, filed by the respondent, under Section 138 of the Negotiable Instruments Act, 1881.
Learned counsel for the petitioners contended that he be allowed to withdraw the present petition with liberty to the petitioners to approach the Court of Sessions by way of filing of revision petition.
Dismissed as withdrawn with the liberty aforesaid. However, if plea of limitation is taken by the petitioners before the learned Revisional Court i.e. the Court of Sessions, the shall be considered sympathetically by the learned Court below. ( Shekher Dhawan) Judge
