Learned State counsel concedes that the petitioner has joined the investigation but he has contended that the petitioner has not handed over the jamabandi relating to his land. A copy of jamabandi can be obtained by the investigating agency from the revenue authorities. Since recovery of cattle has already been effected and the petitioner has joined the investigation, there does not appear to be any necessity of his custodial interrogation, as such interim bail granted to the petitioner vide order dated 11.7.2017 is made absolute, subject to his fulfilling conditions under Section 438(2) Cr.P.C. It is made clear that in case the petitioner is found indulging in any criminal activity later, the prosecution would be entitled to apply for cancellation of the bail.
The petition stands allowed accordingly.
