Having considered the submissions made by learned counsel for the parties and appraisal of the record of the case, this Court is of the considered view that plaintiff had filed suit for possession of suit property pertaining to khasra No. 21/5 measuring 5 marlas as per jamabandi for the year 1999-2000. As per plaintiff, he was in possession of the suit property as co-sharer and had placed parali, goharas and installed khuntas in the same and had also constructed Chabutra of Peer for worship. Earlier, plaintiff had filed suit for permanent injunction and during pendency of the suit, plaintiff had been dispossessed forcibly and thereafter he had filed the present suit for possession. As per defendant, he had purchased the suit land and he is in possession thereof. Plaintiff Ajmer Singh appeared as PW.1 and deposed that suit property is measuring 5 marlas and he is owner to the extent of 2.5 marlas. He had purchased the said land about 27/28 years back. The other co-shares in the suit property are, namely Kali Ram, Shrawan, Anant Ram and Gyasu, whereas defendant has no concern with the suit property and defendant is in illegal possession of the same.
