The appellants through their writ petition sought a direction to Haryana Public Service Commission for introduction 'Standard Statistical Scaling and Moderation Procedure' for evaluation of the answer sheets of Haryana Civil Services (Executive Branch) and other allied services examination 2014. Such a direction was sought on the strength of the judgment of Hon'ble Supreme Court in Sanjay Singh and another versus U.P.Public Service Commission and another, (2007) 2 SCC 720 as well as a judgment of Patna High Court in the matter of 53rd to 55th Combined Competitive Examination Candidates Association versus The State of Bihar and others (Civil Writ Jurisdiction Case No.3892 of 2011, decided on 26.08.2011.

Learned Single Judge has dismissed the writ petition vide selfspeaking speaking order dated 29.08.2016, giving rise to this intra-court appeal.

We have heard learned counsel for the appellants and gone through the record.

It appears that, like the cited decision, the appellants also raised the issue primarily in public interest. They however, cannot be permitted to do so as they themselves are/were candidates in the subject examination and have rushed to the Court only after they failed to qualify the main examination. This Court might entertain such a lis if the questions are raised by a public spirited person in pro-bono-publico, a s and when any such petition is filed. It is clarified that the order under appeal will not cause any impediment against entertainment of such petition under public interest jurisdiction.
