This petition is filed seeking quashing of FIR on the basis of compromise.
On asking of the Court, it has been informed by ASI Jagdish, Investigating Officer that challan has not yet been presented.
In view of the status of the investigation, I am of the opinion that it is always open to the injured and the complainant and other affected parties to approach the Investigating Officer by voluntarily offering to make a statement. If any statement is offered, the Investigating Officer is bound to record the same as per the provisions of Section 163(2) Cr.P.C. In case, any such statement is offered, the same may be recorded by the Investigating Officer and form the opinion to present challan
