The present revision petition is at the instance of the driver against the award, whereby, compensation of Rs.70,000/- has been granted. The owner (National Transport Company) filed the appeal challenging the fastening of the liability vide which it was held that owner is not liable to pay the compensation. There was a remedy of filing an appeal which the Driver was required to file, to question the legality of the award but he filed the revision petition, wherein, the parties had participated and delayed the proper adjudication of the lis. The consequences of award cannot be circumvented by filing a revision.
In view of the aforementioned fact, revision petition is dismissed being not maintainable.
